| 1.3 Ticket
Purchase Policy: |
Pursuant to Spanish law, Esende Europa S.L. hereby discloses
that the purchase price of the tickets in most cases contains a service charge
or profit which has been added to the face value or Esende Europa S.L.`s
purchase price of the tickets, and that, of the date of this Contract, Esende
Europa S.L. has contract to obtain the tickets at a certain price from FC
Barcelona or from a person who has a contractual right to obtain the tickets
from the primary contractor. In these cases Esende Europa S.L. will by accepting
the order take an assignment to obtain or source the ordered ticket(s) on behalf
of the BUYER. Esende Europa S.L. may in some cases only act as an agent for the
seller of the tickets or make the marketplace
www.barcelona-football-club-tickets.com available for ticket sellers for certain
events. In all circumstances Esende Europa S.L. will give the same guarantee of
delivery according to these terms and conditions and our Order Guarantee, unless
otherwise specified in team / tournament specific terms and
conditions. |

The price indicated in the order and invoices must be paid in
its entirety within the due date(s) of the invoice(s) in the order or the order
will automatically be cancelled. Credit card payments must be verified by the
credit card company (online), or the order will automatically be
cancelled. |
|
Double bookings may occur as a result of offline telephone
booking and bookings during system maintenance. Esende Europa S.L. therefore
reserves the right to cancel any online bookings within 48 hours after order
time. Any cancellation because of this will be sent by e-mail and/or by post
within 48 hours. Any deposit paid will be fully refunded immediately, but Esende
Europa S.L. will not pay any extra compensation according to our Order Guarantee
for such cancellations. After 48 hours any orders not cancelled are binding for
Esende Europa S.L. according to these terms and conditions. |
Should Esende Europa S.L. fail to deliver to a BUYER the full
quantity of tickets contracted for, Esende Europa S.L. s' sole obligation or
liability shall be limited to the return to BUYER maximum 200 % of any deposits
and/or payments for undelivered tickets previously made by BUYER to Esende
Europa S.L. under this Contract and according to our Order
Guarantee. |

Esende Europa S.L. deliver tickets and hospitality packages
(event packages) solely, and are not liable or shall not pay any form of
compensation in case of deferment or in case of cancellation of entire or parts
of Event(s). In case of cancellation of an event, Esende Europa S.L. will refund
50% of the purchase price. Any delivery charges will be fully refunded. In case
of changes of time and date of an event with less than 48 hours, the order will
be valid and can not be cancelled. In case of changes of time and date of an
event with more than 48 hours, the BUYER can choose between a 50 % refund or
keep the order valid for the new date. The BUYER must inform within 1 week after
the change of Date if he wants a refund of 50%, if not the Order will be valid
for the new date. Esende Europa S.L. offers tickets for several thousands events
so we might not be able to inform about all changes. The BUYER is therefore
requested to check the official event organizer or venue web site for any
changes. Neither party shall be liable for its delay of performance or its
failure to perform hereunder, owing to causes beyond its control.
Notwithstanding the above Esende Europa S.L.`s maximum liability to the BUYER
shall be 200 % of any deposit and/or payments for orders made to Esende Europa
S.L.. |

All ticket orders are binding for the BUYER and cannot be
cancelled without written acceptance of cancellation by Esende Europa S.L.. All
deposits are non refundable. If the BUYER wants to cancel an order, Esende
Europa S.L. might accept this with a 50% cancellation fee. However this must be
agreed in writing by Esende Europa S.L.. |

Esende Europa S.L. is not responsible for any delivery
failures due to incomplete addresses entered or given by the BUYER. Esende
Europa S.L.`s only responsibility is to send and ship the tickets through a
reputable courier or postal company according to address / delivery instructions
from the BUYER. The BUYER must make sure that he or somebody else on his/her
behalf is available to receive the tickets and if necessary take contact with
the courier company to make sure that the ticket(s) is (are) delivered and
received. |
|
If the BUYER's first choice of ticket category is not
available Esende Europa S.L. reserve the right to upgrade or downgrade (with
partial refund) the order to the next available category. Please note that
Esende Europa S.L. nearly always deliver the tickets in the category ordered and
that any downgrade of category is very rare. Any partial refund will be
calculated based on ticket prices at the time when the order was placed. Esende
Europa S.L. will keep record of all changes in prices and historical
data. |

In case of additional services sold with tickets such as
courier delivery, hospitality services etc., Esende Europa S.L. reserve the
right to change the details of mentioned services in case of any changes done by
third parties (providers of these services to Esende Europa S.L.). Esende Europa
S.L. guarantee mentioned services only based on the contracts with third parties
providing these services to Esende Europa S.L. Updated information regarding

In case of team event orders Esende Europa S.L. will only
deliver tickets to supporters in the section of the team they are supporting or
in neutral area or area with no opposite team supporter. The BUYER is
obliged to give information about this when ordering. In case the BUYER does not
support any of the teams Esende Europa S.L. might supply ticket(s) in neutral
zone or any section available unless otherwise agreed in
writing. |
|
All payments made by credit card are being debited in the
currency Euro or NOK. Esende Europa S.L. updates currency rates weekly. Any
currency fluctuations and currency loss, as a result of this, are the BUYERS's
sole responsibility and the BUYER will hold Esende Europa S.L. harmless of any
such possible loss. |
|
Esende Europa S.L. will in each order indicate dates (and
time) of delivery or pick up. This is only for guidance and in case of delay's
Esende Europa S.L. is entitled to deliver tickets up to 24 hours before the
event without being in breach of the entered agreement of any ticket
purchase. |
|
The BUYER is obliged to inform Esende Europa S.L. of any
change in address and where tickets can be delivered up to 24 hours before the
event. Esende Europa S.L. may also instruct the BUYER to pick up tickets at box
office or the venue. In case of pick up at box office or venue, delivery charge
will be refunded. |
| Esende Europa S.L. is not
responsible for lost, stolen, damaged or destroyed tickets once tickets are in
BUYERS' physical possession. |

Any complaints or claim of refund regarding a ticket purchase
must be made in writing and received by Esende Europa S.L. at the latest 5 weeks
after the relevant event date. Complaints must be sent to: Esende Europa S.L.
as, Sant Josep Oriol 4 2º 1ª, 08002 Barcelona-Spain. Complaints after this date
will not be reviewed. Esende Europa S.L. will normally review a complaint or
claim of refund within 4 weeks after it has been received. |

Indemnity: |

Governing Law: |
